TERMS AND CONDITIONS

Delivery:

Delivery can be to any address as long the address at which your payment card is registered is also present on your order. All deliveries must be signed for. Please make sure you keep the receipt enclosed with your goods.

When you add products to your Shopping Basket, the appropriate delivery charge will be added automatically. You will always be able to see this charge before submitting your order.


All delivery timescales are subject to product and delivery slot availability. Delivery is next working day subject to availability in India. However, delivery may take up to five working days.

The contents of your order and your delivery postcode area will determine which delivery services you will be offered. We do not deliver to Post Office (P.O.) boxes or shipping agent addresses.

Delivery will be between the hours of 7am and 9pm; we are unable to confirm a time.

Boier Haat will select the most appropriate carrier for your goods. This means your delivery may arrive in more than one batch to ensure your order is transported in the best possible way.

Whilst every reasonable effort shall be made to keep to any delivery date, time of delivery shall not be of the essence and Boier Haat shall not be liable for any losses, costs, damages or expenses incurred by the customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date. The risk in the goods shall pass from the company to the customer upon delivery of such goods to the customer.


Postage / Shipping charges:


You will only pay one delivery charge per order, which will be the highest depending on the contents of your order and your chosen delivery service. When you have added items to your shopping basket, the standard delivery charge for those products will be automatically applied to your order. If we feel that you have been over charged for Postage / Shipping we will endeavour to send a voucher to you to reduce the amount of your next order.
If goods upon delivery are found to be damaged then NO claim can be made against Boer Haat. All items are dispatched from our store after firstly being inspected prior to packaging. Images are then taken which are date & time stamped to show parts are undamaged prior to packaging. Our couriers do not offer insurance cover for the carriage of books and we in turn will not be accepting liability or responsibility for replacement of items/goods damaged in transit.
If goods upon delivery are found to be damaged, then NO claim can be made against Boier Haat.
Any claim that any Goods have not been delivered to you by us or our appointed carriers where we claim we have delivered the same to you, or left the Goods in a safe place or delivered the Goods to your neighbour and/or our appointed carriers have obtained a signature for the delivery of the Goods (from any of the above (where applicable), such claim must be notified by you to us within 2 days of their expected delivery. We shall then liaise with our carrier and/or our driver and we may require copies of two forms of personal identification documents from you (such as passport, driving licence, bank card etc.) or any third party. Once we have reviewed all documentary evidence and statements from the relevant drivers we shall then come back to you within a reasonable timescale of our decision (to replace such Goods, issue you with a credit note for the price of such Goods, refund the price paid for such Goods or to not provide any of the aforementioned) which shall be final and binding. The provisions of this clause set out your sole remedy in such circumstances.
Any consignment that is attempted delivery on a number of occasions and not collected from the local depot or not arranged to be re-delivered within the grace period, also if a parcel is refused upon delivery and returned to Boier Haat, there will be a surcharged of ₹25+GST per parcel that is returned to Boier Haat.


Returns:


If you as a consumer decide that you do not want any item which was bought on the Website/Apps and we have delivered, then provided that it is returned to us in its original and unused condition, not fitted in anyway and dispatched within 14 days of delivery unless otherwise agreed prior with Boier Haat we will exchange it or offer a refund for the product. The consumer is responsible for the cost of returning the item. A re-stock charge of 15% minimum may be applied subject Boier Haat discretion for diminished value.
At the discretion of Boier Haat, any goods supplied correctly by as ordered by the customer provided that it is returned to us in its original and unused condition, NOT fitted in anyway and within 3 days of delivery unless otherwise agreed prior with Boier Haat, we will exchange it.
The customer is held responsible for the return of the goods to Boier Haat unless prior arrangements are made with Boier Haat.
Refunds will only be given once the goods have been returned in good order and in its original packaging. Please take reasonable care of the Goods as we are entitled to deduct an amount from the refund to reflect any loss in value of the goods supplied to you, if the loss is the result of unnecessary handling of the goods by you. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last Good(s).
No refund or return will be accepted on "Auctioned" goods that are a part ordered by Boier Haat on behalf of the customer. These are not stocked items and therefore will not be accepted for a return or refund. Any goods listed as "Auctioned" will also NOT be eligible for any refunds, even if wanting to be returned before the 14 days, "Auctioned" means specifically ordered for your purchase and therefore non-returnable.
Goods must be checked prior opening any package, opaque or transparent. No responsibility whatsoever is accepted for the damage or associated parts of any goods.
We will normally refund any money due to you using the same method originally used by you to pay for your purchase. This may take your bank approximately 3-5 working days from the date the refund is processed by us.

Please Note: We will not accept responsibility for loss or damage of returning Goods during transit.

Cancellation of Orders:
You are able to cancel your order prior to shipping with no cost penalty being incurred and full credit of your account if monies have already been taken. You can cancel an order by following the links on the Boier Haat website www.boierhaat.com, or by phoning us on +91 7044472233 within 10AM to 5PM.

We shall have no liability for incorrect Goods purchased by you online for foreign registered cars once the cancellation period ends 14 days after delivery.

We aim to process and dispatch all orders taken before 3pm within the next day of purchase. Delivery transit time, depends on geographical area but we aim to deliver within 3-5 working days if the address is in India.

To exercise the right to cancel email customer services on orders@boierhaat.com  or call +91 7044472233 to inform us of your decision to cancel your order by a clear statement (setting out your name, geographical address, order number and, where available, your telephone number and an e-mail address). You may use the attached model cancellation form, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.


Defective Goods


If any goods are required to be replaced, for whatever reason, Boier Haat will only deliver to the original address the goods were shipped to.
If you purchase a product from us that are found to be faulty we will supply a replacement or arrange for a refund of the purchase price if a replacement is not available. To arrange the return of the defective goods please contact our office on +91 7044472233 or email orders@boierhaat.com.  Upon receipt of the product we will examine it or we may have to return it to the publisher for examination before it can be accepted as a defective item. We aim to dispatch a replacement product or refund your money within 14 days or a reasonable period.


Defective Goods - Overseas


If shipped by Boier Haat outside of India then it will be the customers’ responsibility to return and arrange the carriage for the replacement goods.
Any goods the customer has collected and shipped out of India and found either not to fit must be returned to Boier Haat, ndia address by the customer for any warranty on the product for whatever reason.
Boier Haat will not be held responsible for any carriage or transportation outside of India to bring back any defective part; this will be the sole responsibility of the customer without exception.
Warranty of any goods will only be applied to and within India.
Overseas customers whom purchase goods do so by agreeing to our Terms and Conditions without exception.
The customer must provide adequate paper work details received with the initial order, such as invoice number or Customer number in order for us to proceed with any claims. It is the responsibility of the customer and not Boier Haat to source and provide these details prior to any claims.

The goods should also be returned with their original box, complete packing and accessories.

If the return is due to missing or faulty parts then we will offer a replacement provided we are aware of this within 3 working days.
We will normally refund any money due to you using the same method originally used by you to pay for your purchase. This may take your bank approximately 5-7 working days from the date the refund is processed by us.

Force Majeure:


Boier Haat shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

General T&C
    1) By placing an order with us, you warrant that:
        a. you are a Customer; either consumer or business
        b. you are at least 18 years old and legally capable of entering into binding contracts;
        c. the information you provide to us during the process of placing an order for Goods and/or Services is accurate, complete and not misleading; and
        d. you are fully aware of our Terms.
    2) You agree that it is your responsibility to ensure that you have ordered the correct Goods from us and that the Goods suitable and fit for the purpose(s) they are intended to be used for by you. Unless we expressly state otherwise, in writing, we do not provide advice on such suitability.
    3) You further agree and must ensure that the information you provide to us during the process of placing an order for Goods and/or Services is accurate, complete and not misleading. We shall not be held responsible for any inaccuracies incomplete or misleading information you provide to us.
    4) Our employees, representatives or agents are not authorised to make any representations concerning the Goods or their installation unless confirmed by us in writing. You acknowledge that you do not rely on any representations that have not been confirmed in writing. Nothing in these Terms affects the liability of either party for fraudulent misrepresentation.
    5) Any advice or recommendation given by our employees, representatives or agents to you or your employees as to the storage, application, use, servicing or maintenance of the Goods which is not confirmed in writing by us is followed or acted upon entirely at your own risk, and we shall not be liable for any such advice or recommendation which is not so confirmed in writing.
    6) We retain all copyright and title to all documentation relating to Goods delivered to you by us. This documentation may only be used for the purposes intended in any contract between us and you and not for any other purpose without our permission. It must be returned on demand.
    7) The price(s) of the Goods will be as quoted in our Product Information or any other marketing literature from time to time except in cases of error. The prices may be altered at any time without notification to take into account any increase in our costs (including but not limited to the cost of materials, labour, transport or other overheads, any tax, duty or variation in exchange rates).
    8) For Goods purchased via our Website, the price you pay is the price displayed on this Website at the time we receive your order apart from the following exceptions:
        a. For Goods reserved online via our click and collect facility or via any other reservation service the price you pay is the price on the day of collection;
        b. While we try and ensure that all our prices on our Website are accurate, some prices may be incorrectly listed. If we discover an error in the price of the Goods you have ordered, we will inform you as soon as possible and offer you the Goods at the correct price. We are under no obligation to provide Goods or Services to you at an incorrect, lower price, even after we have acknowledged your order or despatched the Goods or started performance of the Services. If we cannot contact you, we will treat the order as cancelled. If payment has been made and you wish to cancel your order, you will receive a full refund of the price paid;
        c. Please note that the prices payable for Goods and Services in-store may vary from those stated on our Website
    9) Where there is no error in our pricing or otherwise, the prices that you pay for the Goods will be those at the date of despatch of the Goods.
    10) We list prices as both inclusive and exclusive of GST. All prices are exclusive of any other sales tax or duty that may be applicable which will be payable in addition to the price unless otherwise stated.
    11) Unless otherwise specified, the delivery costs (if any) will be quoted at the time you place your order for Goods. The entire cost of any other mode of transport or any special deliveries other than the standard delivery service we offer, will be borne by you, as will delivery to locations outside of India.
    12) No allowance will be credited for Goods collected from our premises by you rather than delivered by us.
    13) We reserve the right by written notice to you before completion of the Contract to vary the price of the Goods to take into account increases in costs including (without limitation) the costs of any materials, carriage, labour or overheads, the increase or imposition of any tax, duty or other levy and any variation in exchange rates.
    14) Where goods purchased by the buyer are alleged to be defective, the purchaser agrees to return such goods to the seller for inspection and report (without the seller replacing the said goods prior to such inspection). The purchaser also accepts that it is reasonable to inform the seller of any interruption, defect or other failure prior to contacting independent third parties or incurring expense and, in addition, to allow the seller to remedy the defect, failure or interruption.
    15) Where any valid claim in respect of any of the Goods which is based on any defect in the quality or condition of the Goods or their failure to meet specification is notified to the Seller in accordance with these Conditions, the Seller shall be entitled to replace the Goods (or the part in question) free of charge or, at the Seller’s sole discretion, refund to the Buyer the price of the Goods (or a proportionate part of the price), but the Seller shall have no liability to the Buyer.
    16) The Seller shall not be liable to the Buyer by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of the Seller, its employees or agents or otherwise) which arise out of or in connection with the supply of the Goods or their use or resale by the Buyer, and the entire liability of the Seller under or in connection with the Contract shall not exceed the price of the Goods, except as expressly provided in these Conditions.
    17) The Seller shall not be liable to the Buyer or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of the Seller’s obligations in relation to the Goods, if the delay or failure was due to any cause beyond the Seller’s reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond the Seller’s reasonable control
    18) The customer must provide adequate paper work details received with the initial order, such as invoice number or Customer number in order for us to proceed with any claims. It is the responsibility of the customer to source and provide these details prior to any claims.

Please make sure to forward all shipping documents & labels you will receive by email to orders@boierhaat.com. We will then attach the documents to the parcel ready for collection.


Warranty and liability policy


Subject to the condition set out below the seller warrants that the goods will correspond with their specification at the time of delivery or collection and will be free from defects in material and workmanship as detailed on the product description. The Seller shall NOT be liable for any labour or associated claims should a product fail, warranty will however apply to any part or parts purchased by the buyer within the warranty period to include carriage to replace the original purchased goods.

Warranty subject to the following condition applies:

    • Where goods purchased by the buyer are alleged to be defective, the buyer agrees to return the goods to the seller for inspection and report (without the seller replacing the said goods prior to such inspection). The buyer also accepts that it is reasonable to inform the seller of any interruption, defect or other failure prior to contacting independent third parties or incurring expense and in addition, to allow the seller to remedy the defect, failure or interruption.

    • Any claim by the buyer which is based on any defect in quality or condition of the goods or their failure to correspond with the specifications shall be notified to the seller within 3 days from the date of sale. If the buyer does not notify the seller accordingly, the buyer shall not be entitled to reject the goods and the seller shall have no liability for such defect or failure, and the buyer shall be bound to pay the price as if the goods had been received in accordance with the contract.

    • Where any valid claim in respect of any of the goods which is based on any defect in quality or condition of the goods or their failure to meet specification is notified to the seller in accordance to these conditions, the seller shall be entitled to replace the goods free of charge or at the seller’s sole discretion, refund to the buyer the price of the goods (or a proportionate part of the price), but the seller shall have no liability to the buyer.

    • Except in respect of death or personal injury caused by the seller’s negligence, the seller shall not be liable to the buyer by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, for any indirect, special or consequential loss or damage, loss of profit or otherwise, costs, expense or other claims for compensation whatsoever (whether caused by the negligence of the seller, its employees or agents) which arise out of or in connection with the supply of the goods or their use by the buyer, and the entire liability of the seller under, or in connection with the contract shall not exceed the price of the goods, except as expressly provided in these conditions.

    • The seller shall not be liable to the buyer or be deemed in breach of the contract by reason of any delay in performing, or any failure to perform, any of the seller’s.
Obligations in relation to the goods, if delay or failure was due to any cause beyond the seller’s reasonable control:
    • Act of God, explosion, flood, tempest, snow, fire or accident
    • War or threat of war, sabotage, insurrection, civil disturbance or requisition.
  • Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority.
    • Import or Export regulations
    • Strikes, lock-outs or other industrial actions or trade disputes (third parties included).
    • Difficulties in obtaining the raw materials, labour, fuel, parts or machinery.
    • Power failure or breakdowns.
